Judicial Review over Fear-Based Claims in Reasonable Fear or Withholding-Only Proceedings

On June 21, 2024, the Third Circuit ruled that the Court has jurisdiction to review fear-based claims arising in reasonable fear or withholding-only proceedings if the noncitizen files a petition for review within 30 days of the conclusion of those proceedings. The court also held that the deadline for filing a petition for review is not jurisdictional, but is instead a claims-processing rule. In so ruling, the Court adopted the arguments that NILA made as amicus. To read the decision, click here.
