NILA and Constitutional Accountability Center File Supreme Court Amicus Brief in Riley v. Garland

On January 10, 2025, NILA and the Constitutional Accountability Center (CAC) filed an amicus brief in Riley v. Garland. In that case, the Court will address whether the deadline for filing a petition for a review is jurisdictional or a claims-processing rule and/or whether a noncitizen can obtain review of a decision in a withholding-only proceeding by filing a petition within 30 days of that decision. Our brief argued that the deadline is a claims-processing rule. It also argued that, although the Court need not decide whether the deadline is mandatory or subject to equitable exceptions, the deadline is subject to equitable tolling.
