Senator Chris Murphy (D-Conn.) recently introduced the Strengthening Immigration Procedures Act, legislation intended reform the process for ineffective assistance of counsel claims in immigration court, to Congress. For decades, the Board of Immigration Appeals has required individuals making ineffective assistance of counsel claims to file bar complaints against their prior attorneys. This onerous requirement, which appears nowhere in the immigration statutes or regulations, has caused confusion and inefficiency for pro se individuals and immigration attorneys, including NILA members. NILA supports efforts to remove this requirement.
